These terms cover subscriptions, service-area clusters, lead eligibility and exclusive lead purchasing for businesses on Kickbacks.

1. Scope
These Business Terms apply to businesses using Kickbacks, operated by Kickbacks for Kids (ABN 17 611 988 900). They apply in addition to our Terms of Use, Privacy Policy and Lead Refund Policy. If there is any inconsistency on a business-specific matter, these Business Terms prevail.
2. Business profile and access to lead purchasing
- Creating and maintaining a business profile is free.
- Purchasing leads requires either an eligible paid subscription, or an explicit access grant made by a Kickbacks administrator. New businesses start with no purchasing access.
- An administrator grant is discretionary, may be time-limited, is recorded in an audit log, and may be withdrawn.
3. Subscription plans
- Business Pro — AUD $99 per month, 1 service-area cluster.
- Business Pro Plus — AUD $249 per month, 3 service-area clusters.
- Business Pro Max — AUD $400 per month, 6 service-area clusters.
- Business Enterprise — AUD $1,399 per month, 20 service-area clusters, plus expanded business tools and support. Inclusions are still being rolled out — contact support@kickbacks.app for current inclusions and upcoming features.
Launch offer: for the first 3 months of a subscription the included cluster allowance is doubled, then it reverts automatically to the standard allowance.
Prices are in Australian dollars. Where GST applies it is shown at checkout. Lead purchases are charged separately from the subscription.
4. Service-area clusters and locking
- Business Pro and Business Pro Plus: your cluster selections are locked for self-service once established, and remain locked across normal renewals, unless Kickbacks introduces a controlled change window.
- Business Pro Max: you can adjust your clusters yourself at any time while the plan is active.
- A Kickbacks administrator can always change a business's clusters. Every administrator change is recorded in an audit log with the previous and new selections.
- Clusters are commercial territories used for matching. They are not exclusivity, not territory ownership and not a guarantee of lead volume. More than one business can hold the same cluster.
- Kickbacks may restructure, split, merge or rename clusters as coverage improves. We aim to preserve equivalent coverage and will give notice where a change materially affects you.
5. Upgrades, downgrades and history
- Upgrading, or starting a new paid term, resets any cluster lock so you can reselect within your new allowance.
- Downgrading does not silently delete your selections. If you hold more clusters than your new plan allows, existing selections are retained and flagged as over allowance, further additions are blocked, and you can reduce your selections at any time.
- Historical cluster selections and changes are preserved in the audit log.
6. Billing, renewal and cancellation
Subscriptions bill monthly in advance through Stripe and renew automatically until cancelled. You can cancel at any time from the billing portal. Cancellation stops future renewals; it is not a refund of the current period. Access generally continues until the end of the paid period, subject to law and to suspension for breach.
Failed payments may suspend purchasing access until resolved. We may change prices or plan inclusions prospectively, with reasonable notice before a material change takes effect. If you do not accept a material change, you can cancel before it applies.
7. Lead eligibility
Whether a lead is visible or purchasable by you depends on the requested service and its delivery mode, the relevant geography and your selected clusters, your subscription or granted access, any licence or credential requirements for a regulated service, your notification and search preferences, whether the lead has already been purchased, and your account standing. Eligibility rules are enforced server-side and may change as the taxonomy and territory structure evolve.
8. Exclusive leads and what a purchase unlocks
- Purchasing a lead gives you exclusive access to the customer details associated with that specific posting at the time of purchase: that posting is sold to one business only, unless it is legitimately relisted (for example after a refund, or where the original purchase failed). This is subject to our platform, refund and relist rules.
- The customer keeps the right to cancel or amend their request, and to create a new request or repost substantially the same work at any time — including where they are not satisfied with a business, the work is incomplete or unresolved, or they want another provider or quote. A later repost or new request is a separate lead and may be offered to eligible businesses under these terms.
- A customer repost does not by itself entitle you to a refund of the original purchase. Refunds remain governed by the Lead Refund Policy and applicable law.
- A purchase may unlock the customer's permitted name, phone, email and request details.
- A purchase never unlocks the customer's street address or precise coordinates. You will see suburb or locality, city or region, state or territory, postcode and service area only. Attempting to circumvent this is a serious breach.
- Purchasing a lead gives you access to an enquiry. It is not a guarantee of contact, engagement, acceptance of a quote, completion of the work, job value, conversion or revenue.
- The lead price is displayed before you purchase. Each purchase creates a corresponding allocation for the nominated club. If that club is verified, the amount is credited to its ledger. If the club is not yet verified, the amount is held as a pending allocation while Kickbacks invites the club to verify, and if verification is not completed within the applicable period the amount may be transferred to the Kickbacks Program Fund under our platform rules. Allocations may be reversed if the purchase is refunded or reversed. Where the allocation sits does not change the price you pay or what your purchase unlocks.
9. Refunds
Lead refunds are governed by the Lead Refund / Invalid Lead Policy, which forms part of these Business Terms.
Under that policy the ordinary platform claim window is 7 calendar days from the lead purchase. Submitting a claim is a request for review against the policy, not an automatic entitlement to a refund, and you may be asked for reasonable evidence appropriate to the reason you select. We may still review a claim outside the ordinary window where the law requires it or where there is a clear platform, payment or fraud issue.
Nothing in this clause or in that policy excludes, restricts or modifies your rights under the Australian Consumer Law.
10. Licensing and regulated services
You must hold and maintain every licence, registration, accreditation and insurance required for the services you offer, in each jurisdiction where you work, and must supply accurate details on request. Some services are flagged as regulated and may be restricted until credentials are provided. Our checks, including any Verified Insurance badge, are administrative only and based on the evidence you supply: they confirm that we reviewed evidence of public liability insurance which had not expired at the time recorded. They do not make Kickbacks a regulator, warrant your competence, or reduce your obligation to keep all required licences and insurance current and adequate for each job.
11. Use of customer information
You may use customer information obtained through a purchased lead only to:
- respond to that enquiry and quote for the work; and
- maintain a legitimate ongoing customer relationship arising from it.
You must not resell, publish, share or transfer it, add it to unrelated mass marketing lists, use it for harassment or repeated unsolicited contact, or retain it beyond what your own legal obligations require. You are responsible for your own compliance with the Privacy Act and the Spam Act.
12. Notifications
Email and web push matched-lead notifications are included for every business account, subject to your opt-in; an opt-out always wins. SMS notifications are available only to businesses with an eligible active paid subscription, and require separate explicit consent and provider availability. An administrator grant of purchasing access does not by itself enable SMS unless SMS is separately configured for your account.
13. Your responsibility for the work
You are solely responsible for the services you deliver, for your employees, contractors and subcontractors, for workplace health and safety, for your taxes and insurance, and for meeting your obligations under the Australian Consumer Law and any industry-specific regulation. Your agreement with the customer is between you and the customer.
14. Fair use, suspension and termination
We may apply reasonable fair-use limits to searching, notifications and API-like activity. We may suspend or terminate business access for non-payment, fraud, abuse of the refund process, circumvention of privacy or exclusivity controls, misuse of customer data, unlicensed operation in a regulated service, or serious or repeated breach. Where practical we will tell you why and give you an opportunity to respond.
15. Intellectual property, liability and indemnity
Kickbacks owns the platform, its taxonomy, territory structure, branding and software. You keep ownership of your business content and grant us a limited licence to display it for the purpose of operating and promoting the platform.
To the extent permitted by law, and subject to rights that cannot be excluded under the Australian Consumer Law, our liability to a business is limited to resupply of the relevant service or a refund of the amount paid for it, liability is reduced proportionately to the extent your own acts or omissions caused the loss, and you indemnify us against claims arising from your services, your use of customer information and your breach of these terms.
