Club Terms

These terms cover claiming a club, club manager access, public club pages, the club ledger and payouts.

1. Scope and cost

These Club Terms apply to clubs, club claimants and club managers using Kickbacks, operated by Kickbacks for Kids (ABN 17 611 988 900). They apply in addition to our Terms of Use and Privacy Policy.

Clubs can be listed, claimed and managed on Kickbacks free of charge, unless we later state otherwise with reasonable notice.

2. Claiming a club

  • A claimant must be authorised to represent the club, and must provide accurate, current and complete information about themselves, their position and their relationship to the club.
  • Claim statuses are pending, verified and rejected. A pending claim grants no Club Manager rights. A verified claim grants the appropriate Club Manager access for that club. A rejected claim grants no access.
  • We may request evidence, contact the club through an official channel, verify the claimant's authority, ask for further information, and reject or suspend a claim where authority cannot be verified or the information supplied is inaccurate or misleading.
  • Claim statuses are not roles. Verification of a claim results in Club Manager access for that club only.

3. Public club pages

A public club page may display the club's name, logo, sport, suburb, state and region, public contact information supplied by or on behalf of the club, a description, and eligible platform statistics such as supporter and funding activity. Club pages are indexable by search engines. We do not publish supporter personal information on club pages.

4. Nominations and platform integrity

Supporters choose which club they nominate. Clubs may encourage their community to use Kickbacks, but must not:

  • create fake supporter accounts or fake, duplicate or speculative service requests;
  • manipulate nominations or the funding model;
  • collude with a business to generate leads that are not genuine, or to recycle payments;
  • misrepresent the club's affiliation, size, status or authority.

5. The club ledger

  • Each lead purchase nominated to your club may create an allocation. Only a verified club is eligible to receive that allocation as a credit on its club ledger, subject to these terms.
  • Credits may be reversed for refunds, chargebacks, fraud, duplicate or invalid transactions, or platform corrections.
  • A displayed ledger balance is a record of platform activity. It is not the same as cleared or paid funds and does not create a debt owed until the amount has been verified, reconciled and approved for payout.

6. Unverified clubs, pending allocations and the Program Fund

  • An unverified club is not yet entitled to receive allocations. Where a supporter nominates an unverified club, the amount is recorded as a temporary pending allocation. It is not credited to the club, is not held on trust for the club, and is not payable to the club before verification.
  • A 30-day verification window applies, running from the date of the first pending eligible allocation for that club, unless Kickbacks expressly extends or resolves it.
  • Kickbacks may contact the club using publicly listed or club-supplied contact details to invite it to complete verification or claim its profile.
  • If the club completes verification within the window, the eligible pending allocations are moved once into the club ledger, with the source lead and purchase references preserved.
  • If the club does not complete verification within the window, the eligible pending amounts may be transferred to the Kickbacks Program Fund. Once transferred, the amount is no longer held or payable for that club, except for any discretionary remedy Kickbacks may expressly choose to apply later.
  • The Program Fund is used for initiatives that support and promote grassroots clubs and participation in Kickbacks, and is accounted for separately from subscription revenue.
  • Refund, reversal and fraud provisions continue to apply at every stage. A refunded or reversed purchase cancels or reverses the corresponding allocation wherever it sits, and historical records are retained for audit.

7. Payouts

Payouts are subject to:

  • the club being verified and the claim in good standing;
  • valid payment details held for the club;
  • any minimum threshold or payout schedule we configure and publish;
  • reconciliation of the underlying transactions;
  • fraud, security and sanctions checks; and
  • applicable tax and legal obligations, including any withholding we must apply.

The club must supply correct payout and bank details where required and update them promptly when they change. Except where the law requires otherwise, Kickbacks is not responsible for loss caused by incorrect or out-of-date details supplied by the club.

8. No guarantee of funding

Kickbacks does not guarantee any level of donation or funding, lead volume, supporter activity or revenue for your club. Any figures or examples we publish are illustrative only.

9. Club manager responsibilities

A club manager must keep their account credentials secure, must not share access, and must use any supporter or business information visible to them only for authorised club administration. Club managers must tell us promptly if they cease to be authorised to represent the club, or if they suspect unauthorised access.

10. Updates, duplicates and moderation

A club may request updates to its public information. Kickbacks may correct duplicate club records, merge or deactivate obsolete records, standardise names and locations for consistency, and moderate or remove content that is misleading, offensive, infringing or unlawful.

11. Club logos and content

Club logos, names and content remain owned by the club or its licensors. By supplying them, the club grants Kickbacks a non-exclusive, royalty-free licence to host, reproduce, resize and display them for the purpose of operating and promoting the platform and the club's page. The club warrants it has the right to grant that licence.

12. Suspension and removal

We may suspend or remove a club listing, a claim or club manager access for fraud, impersonation, misuse, unlawful conduct, misleading claims, platform manipulation, or where we cannot verify the authority of the person holding access. Ending a club claim or club manager relationship does not erase legitimate historical ledger, transaction or audit records.

13. Statutory rights and governing law

Nothing in these Club Terms excludes, restricts or modifies any right or remedy that cannot be excluded under Australian law. These terms are governed by the laws of the Australian Capital Territory, Australia, subject to mandatory Australian law. Questions: support@kickbacks.app.
